1. About these terms
These terms apply to the CTC Surfcraft website and craft design tools. “CTC”, “we” and “us” refer to CTC Surfcraft. The quotation, Stripe checkout and invoice identify the seller and payment recipient for your order. Swellix is CTC’s digital service provider; it does not manufacture or sell the craft and does not receive the customer’s craft deposit merely because it built this website. Stripe processes payments for the merchant; using Stripe does not make Stripe the seller of the craft.
Each business remains responsible for its own conduct and obligations. Nothing in these terms excludes liability that cannot lawfully be excluded, including obligations arising from Swellix’s own services. Our returns and consumer guarantees policy and privacy notice apply alongside these terms.
An adult must approve and handle purchases, including nipper-board orders. If acting for a club or another person, you must have authority. Do not enter a child’s personal details in the craft studio.
2. Designs, deposits and confirmed orders
Using the configurator, saving a design or checking deposit availability does not submit a customer order, reserve materials or confirm production. The studio collects craft options and colours only. Online deposits are currently unavailable while Stripe setup is completed.
When enabled, Stripe checkout takes the stated deposit and collects contact and delivery information directly. CTC must check the payment in Stripe and contact you to confirm the final design, fit, availability, total price, freight, extras and production timing. A website return page, design reference or acknowledgement is not proof that funds have cleared or that production has been accepted.
An order becomes binding when you and CTC agree the final quotation and CTC confirms acceptance, subject to any disclosed acceptance conditions. The deposit is credited to that order. If CTC cannot accept the proposed order, it will arrange a refund of the deposit; it will not retain a deposit for an order it declines. Existing purchase agreements remain effective regardless of website or portal labels.
3. Custom craft, measurements and previews
Colour tools, photographs and 3D views help you communicate a design. Screens, lighting and rendering can affect how colours, proportions and finishes appear. CTC will confirm the actual construction, fit, artwork and finish with you before production. Ask for help if an exact colour or measurement is important.
Give accurate measurements and explain your intended use, including competition requirements or particular fit needs. Where CTC measures you or gives fitting advice, we remain responsible for the service and representations we provide.
A preview limitation is not permission to supply a materially different craft. We will seek your agreement to a material change in specifications, appearance or construction. Your design approval does not waive consumer guarantees or excuse CTC from following the agreed specification.
Skis are offered as SLS compliant as standard. Selecting the option to discuss a build without SLS compliance is a contact request only. Any different build and its intended use must be discussed and expressly agreed before production. That option does not waive safety obligations or consumer rights, or represent approval for a particular event.
4. Prices, deposit and balance invoice
Prices and deposits are in Australian dollars. The online craft deposit is 10% of the listed craft price: Fibreglass surf ski $540 on $5,400; Carbon surf ski $640 on $6,400; Racing Mal $247 on $2,470; Nipper board $148.50 on $1,485. Delivery costs and agreed extras are added to the final total and are not charged through the craft deposit link. The optional postcode estimator provides an approximate delivery range, not a binding quote or a guarantee of carrier coverage. CTC confirms the delivery area, metro/rural classification and final charge before the balance invoice. The final quote identifies the total payable, including applicable GST, freight and extras, before you accept it.
The deposit is a part payment, not a second fee. CTC Surfcraft will send a separate invoice for the remaining balance of the agreed total after crediting the deposit. Any due date, production milestone or cancellation charge must be disclosed and agreed; this website does not impose an automatic recurring charge or blanket non-refundable deposit. Contact CTC before paying if you need a special build or a complete quote first.
Payments and checkout information are handled on Stripe’s hosted page when available. Check that the page identifies the expected receiving business and deposit amount before paying. Never put card details, security codes, banking passwords or verification codes into a design, email or support message. Independently verify unexpected changes to payment instructions using CTC’s published phone number.
New prices do not change an accepted order. If an error is discovered before acceptance, CTC will explain it and let you choose whether to proceed; if you do not proceed, any related deposit will be refunded. Refund and consumer guarantee rights remain unaffected.
5. Production, delivery and changes
Production and delivery dates are estimates unless expressly agreed as firm dates. Tell us before accepting a quote if a particular date is essential. We will advise you of a material delay and discuss the available options. Delays do not remove any cancellation, refund or other rights you have by law.
CTC will confirm collection or freight arrangements, the delivery destination and charges. We do not automatically transfer all transit responsibility to you when a carrier collects a craft. Responsibility is determined by the agreed arrangements and applicable law.
Request changes or cancellation as soon as possible. Custom production may limit what can be changed, but any revised price, timing or lawful cancellation charge must be explained and agreed. These website terms do not impose a blanket non-refundable deposit. Change-of-mind returns and remedies for faulty or incorrect goods are explained in our returns policy.
The authorised team portal is a separate service. Removing personal-information forms from this website does not remove existing portal records or determine all of the portal’s privacy and access arrangements.
6. Team portal and account security
Portal access is for approved users carrying out their authorised CTC role. Use your own account, protect passwords and verification codes, and sign out of shared devices. Notify CTC promptly if you suspect account misuse.
Agents must enter information accurately, keep customer records confidential and use them only for authorised order and customer-service work. Do not access another user’s records, export information for unrelated marketing, falsify production or payment updates, or make commitments beyond your authority. Portal access does not itself grant exclusive territory, agency authority or a right to commission; any such arrangement is separate.
CTC may restrict access where reasonably necessary to protect information, investigate suspected misuse or enforce a material breach. Where practicable, we will explain the reason and allow it to be addressed; urgent security incidents may require immediate action. Restriction does not cancel an accepted order or remove your legal rights. Contact CTC to continue legitimate order enquiries while access is unavailable.
7. Using the website responsibly
Use the site lawfully and respect other people’s rights. Do not submit fraudulent orders or impersonate someone, upload malicious files, bypass access controls, interfere with the service or collect private customer information. Automated access must not evade restrictions or place an unreasonable load on the site.
Report a suspected technical or security issue to CTC without accessing, altering or disclosing another person’s information. We may investigate and take proportionate protective action.
8. Designs, photographs and intellectual property
CTC and its licensors retain rights in their branding, photographs, product drawings, website content and software. You may view the site and save or print available order forms and your own design summaries for genuine enquiries and orders. Other commercial reproduction or use of CTC branding requires permission, unless allowed by law.
You retain ownership of artwork and other material you supply. Give us only material you own or are authorised to use, including club and sponsor logos. You give CTC permission to reproduce and make agreed production adjustments to that material only as reasonably needed to quote, fulfil and support your request, including through relevant production providers. This does not give us an unrestricted licence to publish it or use it in advertising.
We will seek separate permission before using identifiable customer photographs, testimonials or customer-supplied artwork for promotion. If material may infringe someone’s rights, we may pause that part of the request and ask for evidence of permission or an alternative.
9. Personal information and communications
The craft studio does not ask for customer names, contact details, addresses, rider measurements, free-text notes or uploads. Its old order-submission and FormSubmit paths are retired. Craft summaries and links contain craft choices only.
When enabled, Stripe collects checkout details and makes relevant information available to the receiving merchant. CTC and authorised staff may use it for orders, invoices, delivery, refunds, support and legal obligations. Personal information is not copied into a customer database by this website. Hosting, security and sign-in providers still process necessary technical or account information. Existing portal records and emails are not deleted by this change.
Read the privacy notice for roles, external services, retention and contacts. Contact CTC to ask about its customer information or raise a concern. An enquiry or payment does not automatically subscribe you to promotional messages.
10. External services and website availability
Links and embedded features, including social media and Downwind Rush, may open services with their own terms and data-handling practices. A link alone is not a product recommendation. External services may receive technical information when loaded or used.
Maintenance, internet problems and service-provider interruptions may make the website or portal temporarily unavailable. Keep copies of important confirmations and contact CTC if you need help accessing an order. We take reasonable steps to maintain the service; these terms do not excuse misleading statements, negligence or obligations that cannot lawfully be excluded.
11. Watercraft use and safety
Surf and open-water paddling involve changing conditions and physical risks. Choose a craft suitable for your skills and intended use, inspect it before paddling, follow care and safety instructions, and comply with applicable equipment and event requirements. Seek suitable instruction or advice where needed.
Website descriptions, simulations and the embedded game are not individual safety assessments or training. Stop using a craft if you suspect a safety-related fault and contact CTC. This section does not ask you to release CTC from liability for defective products or any responsibility imposed by law.
12. Consumer rights and responsibility
Nothing in these terms excludes or limits Australian Consumer Law guarantees or any other rights or liabilities that cannot lawfully be excluded. Eligible customers retain their rights to remedies and reasonably foreseeable loss or damage where the law provides them. See our returns and consumer guarantees policy.
Each party remains responsible for its conduct under applicable law. These terms do not require you to cover CTC’s own negligence or give up all claims because you used the website. We do not impose a blanket exclusion of liability or an unrestricted customer indemnity.
13. Changes, disputes and applicable law
We may update these terms for future website use and requests, displaying the revised date. Updates do not retrospectively change an accepted order. Material changes to an ongoing agreement require any notice and agreement required by law.
Raise a concern with CTC using the contact details on this page and include the relevant order reference. We will consider it in good faith and work towards a timely resolution. You may still contact a consumer protection agency, seek independent advice or use a court or tribunal; contacting us first is not a barrier to an urgent or statutory remedy.
South Australian law and applicable Commonwealth law govern these terms, without displacing mandatory protections that apply elsewhere. Courts and tribunals with lawful jurisdiction may hear a dispute; you are not required to give up a right to bring proceedings locally. If a provision is unenforceable, the remaining provisions operate only to the extent they can lawfully do so.
